TwelfthMan - England Cricket Supporters Club - Terms and Conditions
- In these terms and conditions: "the Club" means the TwelfthMan - The England Cricket Supporters Club; “the ECB”, the England and Wales Cricket Board; “Member” means a registered member of the Club; "the Stadium" means any Test Match Cricket Ground, One-Day International or InternationalTwenty20 Cricket Ground.
Membership - Membership does not guarantee that a member will obtain any match tickets nor does it guarantee admission to any match or any particular section of a Stadium for any given date (for example the Member may not receive tickets to the match of their choice).
- The Club will only communicate with Members via the email address they submitted on subscribing through the TwelfthMan Extra e-newsletter.
- Members cannot join the Club without an email address. Members may update their email address by advising us at twelfthman@ecb.co.uk. If they have not opted in to receive the TwelfthMan Extra or have not ensured that the Club has the correct email for them on the system, neither the Club nor the ECB can accept liability for not ensuring that Members know when ticket access goes live or about other benefit updates.
- To be able to apply for tickets, Members must have joined the Club at least one month before the Club’s access period for each Stadium’s ticket sale commences.
- The Club will use reasonable endeavours to negotiate a period of time during which Members can apply for tickets directly with the stadium in advance of general public sale. However, neither the ECB nor the Club can guarantee that Members will have a priority application period before the general public for all Stadiums.
- Any Member that joins after a sale period for Club tickets for a particular Stadium has commenced, will not be entitled to purchase tickets for that Stadium through the Club.
- If a Member applies for tickets directly with Stadium, the Member will become a customer of that Stadium and will deal with the Stadium on the terms and conditions set out by the Stadium for such sale.
- The Stadium will allocate a minimum number of tickets to be available to the Club for allocation to the Members. Numbers and location of such tickets will depend on the Stadium and specific match or day.
- Member ticket applications for Lord’s will not be made directly with the Stadium but will be made through a third party ticketing partner.
- Ticket applications for Lord’s will be run as a ballot application process in years of high ticket demand.
- Any ticket that is purchased through the Club is subject to the ticket conditions and ground regulations of the relevant ground.
- In the event that a membership card is stolen the member should report this to the Club's Membership Office immediately - 0870 444 3722 or twelfthman@ecb.co.uk
- Duplicate membership cards (where lost) are available at a cost of £5.00 (+50p postage and packing per card).
- Membership cards and match tickets are personal to the member and are not transferable and may not be transferred under any circumstances. All membership cards and tickets remain the property of the Club, the Member being the authorised bailee of the Club,and only entitled to the benefits conferred by them subject to these terms and conditions.
- The dates and times of fixtures for the forthcoming season are subject to change. Every reasonable effort will be made to give as much notice as possible of any change.
- The Club reserves the right to suspend or cancel a Member’s membership and all associated benefits for a period of time or to withdraw their use in the event of a breach of any of the terms and conditions and any applicable regulations or if the Member knowingly does or suffers to be done any act or thing which will in any way harm, misuse or bring into disrepute the Club or the ECB.
- If the remittance tendered in payment of membership is dishonoured, not paid or in any other way refused (other than by the Club), the relevant Member shall be liable to pay the Club's administrative charge of £5.00 (or such other amount as the Club may inform the member in writing from time to time) and any bank or other similar charge incurred by the Club as a result, and such membership shall be immediately withdrawn.
- Nothing in these terms and conditions shall constitute or imply any guarantee of entitlement to a ticket, seat or access to any area of any Stadium.
- Neither the ECB nor the Club shall have any liability to the Member for any losses or damage whatsoever in contract, tort, breach of statutory duty or otherwise for any: indirect; economic; incidental; special; exemplary; or consequential loss. Nothing in these terms shall limit the Club or the ECB’s liability for death or personal injury caused directly by a negligent or intentional act or omission or fraudulent misrepresentation on its part.
- Neither party shall be liable for its inability to perform any obligation where such inability is caused by civil war, riot, revolution, acts of terrorism, sabotage, storm, earthquake, flood, explosion, fire, labour disputes or strikes, acts of government or by any other cause not within reasonable control of the party claiming to be affected.
- Neither the ECB nor the Club shall in any event be liable to return moneys received or pay compensation or damages to any Member or any third party (for whatever reason such compensation or damages may be due) in excess of the membership fee actually received by the Club by the Member as at the date such claim arises.
- Nothing in these terms and conditions seeks to affect the Members’ statutory rights as a consumer under the terms of current unfair contract legislation.
- Each person is entitled to only one membership of the Club. Any person who makes or conspires to make multiple applications will have their membership terminated without compensation.
- The Club reserves the right to refuse any application for membership at its sole discretion without reason.
- Membership of the Club is valid for one year from the date of joining or subsequent renewal.
- Members who have purchased membership and are under the age of 18 may apply for tickets with the consent of a parent or guardian; however when attending matches at any Stadium, those aged 15 years and below must be accompanied by an adult.
- Access to exclusive Member events may be limited, cannot be guaranteed and may be subject to additional payment.
- Availability and access to exclusive Member offers will be further subject to the specific terms and conditions of each offer.
- While they will use their reasonable endeavours to determine that such offers are genuine and achievable, neither the ECB nor the Club is responsible for Stadiums not honouring any discounts and/or offers quoted to Members.
- The Club reserves the right to withdraw any membership upon reasonable notice being given, subject to the right of the Member to a reasonable pro rata re-imbursement.
- Members' welcome packs will be mailed out within 28 days of authorisation where possible. The Club reserves the right to change this on giving adequate notice to members.
- If at any time a provision of these terms is or becomes invalid, illegal or unenforceable under the laws of any jurisdiction, that provision shall be deleted in respect of that jurisdiction to the extent that the terms are still capable of enforcement.
- These terms and conditions shall be governed by English law and submit to the non-exclusive jurisdiction of the English Courts.
